MACY’S ASSOCIATE ELECTRONICS GIVEAWAY EVENT OFFICIAL RULES
The Macy’s Electronics Giveaway Event (the “Event”) begins on April 1, 2008 and ends on May 17, 2008. The Event is sponsored and administered by NewZoom, Inc. (“NewZoom”) and Macy’s. All applicable laws and regulations apply. Void where prohibited or restricted by law.
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN.
Eligibility: Entrants must be at least 18 years of age at the time of entry and must be an employee (store associate, divisional or corporate support group) of Macy’s or Bloomingdales on the day the Event ends. The Event is offered in the 50 states of the U.S. and District of Columbia, except where prohibited by law. Only employees, of Macy’s or Bloomingdales are eligible to participate in the Event. Each Entrant must be a resident of a state where this Event is not prohibited or restricted.
How To Enter: Employee entries must be received on or after April 1, 2008, but no later than 11:59:59 p.m. PST on May 17, 2008. All entrants are required to provide their full name and employee number, as well as contact information in the form of a valid telephone number or email address. In order to receive a prize, each selected entrant may be required to provide proof of identification, as well as proof of age, such as a valid driver's license or passport.
You may enter a total of one time only regardless of the method of entry (through a Macy's eSpot store or internet). Entries will not be acknowledged or returned and all entries and the information contained therein become the property of NewZoom and Macy’s. By entering, entrants agree to be bound by these Official Rules and the decisions of NewZoom and Macy’s, which shall be final and binding. NewZoom and Macy’s reserve the right to disqualify entrants who, in it's sole opinion, violate any of the provisions of the Official Rules. NewZoom reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Event or violates these Official Rules and/or criminal or civil law.
Drawing and Prizes: Macy’s will be awarding five (5) prizes in each of the five (5) groups of entrants. The five groups are composed of entrants at machines in the MNW-MCW division, MNO-MCE division, MMW-MSO division, MCF division, and all internet entrants. Prizes will include a Samsung Camcorder,iTouch, MyVu, Bang & Olufsen Headphones, and Sony Noise-Cancelling headphones. In all, twenty-five (25) prizes will be awarded. One (1) of each product will be distributed per division that exists at the time of the drawing and one (1) for online registrants. Winners will be selected in a random drawing of the eligible entries to be conducted by Macy’s on or around May 21, 2008. The odds of winning depend upon the total number of eligible entries received. Drawings will take place at Macy’s Corporate offices. Winners will be notified by telephone and/or email to the telephone number and/or email address provided in the submitted entry within 10 business days of drawing date. If Macy’s is unable to contact potential winners by telephone and/or email or if any potential winner fails to respond to the prize notification within 5 business days of issuance of notification or if any winner fails to comply with any of these Official Rules or other requirements, that potential winner or winner shall be disqualified and an alternate winner shall be selected through another random drawing conducted by Macy’s. Entrants consent to the use of their name and/or likeness for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Allow 4-6 weeks after verification of winner status for the receipt of prize by first-class U.S. mail.
The approximate retail value of a Samsung Digital Camcorder is $350.00, Apple iTouch is $300, MyVu Headset $200, Bang & Olufsen Headphones is $100 and of the Sony Noise- Canceling Headphones is $70.00. All prizes are nontransferable, non-redeemable for cash and may not be applied as a credit towards any other product or service. Prizes of similar value may be substituted by Macy’s in Macy’s sole discretion. Prizes may be subject to additional terms and conditions. Each winner is responsible for all applicable taxes, fees, and duties with respect to prizes. Macy’s reserves the right to withhold any taxes as required by applicable law. One (1) prize per winner or winner’s household. If, in NewZoom's or Macy’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Event or entries, or if technical difficulties compromise the integrity of any entry and/or drawing, NewZoom and Macy’s reserve the right to terminate the entry period and conduct a random drawing to award the prizes using all eligible entries received as of the termination date. Should the acceptance of additional entries be terminated prior to the stated expiration date, notice will be posted.
LIABILITY LIMITATION: EACH ENTRANT AGREES THAT NEWZOOM AND PARTICIPATING RETAILERS, AND THEIR RESPECTIVE AGENTS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND REPRESENTATIVES (COLLECTIVELY, "EVENTPARTIES") ARE NOT RESPONSIBLE FOR AND SHALL NOT BE LIABLE FOR: (I) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET OR OTHER MALFUNCTIONS, FAILURES, OR DIFFICULTIES, WHETHER HUMAN OR TECHNICAL; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (IV) ANY INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF THE PRIZE OR FROM PARTICIPATION IN THE EVENT; (V) THE UPLOADING OR DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS EVENT; (VI) ANY CONDITION THAT MAY CAUSE THE EVENT TO BE DISRUPTED OR CORRUPTED; AND/OR (VII) ANY ERRORS IN ANY MATERIALS ASSOCIATED WITH THE EVENT. IN NO EVENT SHALL ANY EVENT PARTY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, INCURRED BY ENTRANT OR ANY THIRD PARTY, WHETHER BASED ON WARRANTY OR IN CONTRACT, TORT, OR OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES, ARISING FROM THE EVENT OR PRIZE, EVEN IF SUCH EVENT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NEWZOOM RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SUSPEND, MODIFY OR CANCEL THIS EVENT AT ANY TIME, INCLUDING WITHOUT LIMITATION, IF A COMPUTER VIRUS, BUG, OR OTHER TECHNICAL PROBLEM OR CAUSE BEYOND THEIR CONTROL CORRUPTS THE ADMINISTRATION, SECURITY, OR CONDUCT OF THE EVENT.
Indemnity: Each Entrant agrees to indemnify, hold harmless, and defend NewZoom and Macy’s, and the Event Parties against any and all third party claims or demands and all related liabilities, damages, settlements, costs, and expenses (including but not limited to, reasonably attorney’s fees) arising out of any act, or omission of Entrant or violation of these Official Rules.

Agreement: Entrant has fully read and understands the Official Rules and agrees to abide by the Official Rules. Governing Law. This Event and these Official Rules shall be governed by and construed in accordance with the laws of the State of California without reference to conflicts of law principles. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the City and County of San Francisco, California.
